ColourTree Design is subject to UK law. The words 'we', 'our/s', or 'the website' refer to colourtreedesign.co.uk. The terms 'you' or 'your' refer to users of the website. The term 'Artwork' refers to all works displayed on the website. The term 'customers' refers any person or persons buying artworks from the website. The term 'Artist/s' refers to the person or persons selling their artworks on the website.

By visiting this website more than once it is assumed you have read these terms and conditions and by continuing to use the site it is assumed that you accept the terms and conditions outlined here. By purchasing or artists displaying their artwork on ColourTree Design you agree to and accept all the terms and conditions outlined here.

Right to Amend Terms and Conditions

ColourTreedesign.co.uk reserves the right to change these Terms and Conditions at any time. The Terms and Conditions that are displayed on the site at the time you are using it are those which shall apply to you, the changes come into effect when they are posted on the website. It is advised that you check the Terms and Conditions from time to time. The last date of change will be displayed at the bottom of the Terms and Conditions page.

Content

ColourTree Design is used by people of all ages and backgrounds and we aim to maintain a website free from any offensive or illegal content. We therefore reserve the right to refuse to display any artworks or content that we deem to be unacceptable for this website. All artist descriptions, artworks, and accompanying text are subject to approval. It is also prohibited to use this website for any illegal activity and all artists must own the copyrights to the art they are selling. ColourTreedesign.co.uk owns all content on this site including logos, graphics and text. The copyright of the artwork is retained by the artist. You must not copy or reproduce any part of these images or graphics from this website.

There are links on this website to other independent websites. ColourTree Design cannot be held responsible for any content held on these third party websites.

Availability

All items shown on the website are available to our knowledge. It is the artist's responsibility to inform colourtreedesign.co.uk of any changes to the artworks themselves or their availability status. The artist must agree to inform colourtreedesign.co.uk as soon as possible if any artwork displayed on the website is sold elsewhere or is made unavailable for sale on the website for any other reason. The artist must agree to do this under all circumstances. In the rare event that an artwork is bought on the website when it is actually unavailable, the customer will be informed. No monies will be taken and a similar alternative piece by the artist may be suggested.

Product Descriptions

The Artist is responsible for providing colourtreedesign.co.uk with an accurate description of themselves, their work and any specific artworks displayed on the website, including medium and dimensions. If customers want any more details about a particular artwork they are free to contact us and we will in turn contact the artist for any additional information. Please note: due to the nature of a computer monitor/screen the artworks colour and appearance may vary slightly from the image on the screen.

Purchases

All purchases made from this website will be subject to these Terms and Conditions. You must accept these Terms and Conditions before making any purchase from this website.

All prices displayed on colourtreedesign.co.uk are in £ sterling, as we are a new small company there is currently no VAT added. We currently use PayPal, which is a trusted leader in online payments. PayPal helps protect your credit card information with industry-leading security and fraud prevention systems. When you use PayPal, your financial information is never shared with the merchant. It is free to make purchases through PayPal.

Before buying an artwork you must add on the cost of shipping, this will be shown as a separate amount on your receipt, and is non-refundable if you decide to return the work for any other reason besides it being damaged.

Payments by cheque are accepted but the artwork will not be dispatched until the cheque has cleared. The artwork will be reserved until this time but will be released for sale again if the cheque fails to clear. Cheques are made out to P. Colyer and send to the address at the bottom of this page.

Delivery

All artwork is sent out through the Royal Mail Postal Service with insurance to protect from loss or damage. All shipping prices shown are for the UK mainland, and include insurance and packaging. Deliveries to Highlands and Islands may incur additional charges. Customers will be notified of any additional charges before the transaction proceeds. If you wish to have the artwork delivered to another country Colourtreedesing.co.uk will have to determine how much extra the shipping will be. Every care is taken with the packaging of artwork so that you receive your goods in perfect condition. Delivery should reach you within 7 to 14 working days from cleared payment.

If the artwork has been damaged during transit , please contact ColourTree Design first before returning the goods. We will give a refund once the goods have been returned.

Cancellations

If a customer wishes to cancel an order for any reason there will be no charge up until the time the artwork has been dispatched, and a full refund will be made (this does not apply to work carried out on a commission basis once payment is made and the comission has been approved no refund will be offered if the purchaser 'changes their mind'). If the order is cancelled after the goods have been dispatched the customer will be refunded the cost of the artwork. The shipping cost will not be refunded. The customer will be responsible for the cost of returning the artwork and ensuring its safety until it is received by the artist. It is advised to leave the artwork in the packaging it was sent in unless for some reason this is not possible, or the packaging is damaged.

Returns
A customer who has purchased an artwork from Colourtreedesign.co.uk is given seven working days from the date of receipt to decide if they are happy with the artwork. If for any reason you decide not to keep the artwork you can return the artwork for a full refund of the price of the artwork (excludes commission work). This does not include the cost of shipping it to you. You are also responsible for the cost and the safe return.

Damaged Goods
Any goods which are received by the customer which is found to be damaged can be returned to the artist for a full refund. Including all postage and packaging costs. It is the artist’s responsibility to take out the necessary insurance when shipping the artwork as well as to make sure the packaging protects the artwork adequately. It is the customer’s responsibility to check all packaging is intact and there is no visible damage to the outside of the packaging before signing for the goods.

Data Protection
At ColourTree Design we are committed to safeguarding customer privacy. All personal information supplied is held securely in accordance with the Data Protection Act 1998. Information collected about you is your name, address, email address, telephone and fax number. Your details will be protected and will not be given to third parties except for the delivery of print items as necessary. We only use information provided to manage your account with us and to communicate with you during transaction and until any opt in email service is finished.
